General conditions of use - Dreambooks Editor

Welcome to the Dreambooks Editor!
Please read the general terms and conditions of use carefully.
The general terms of use (GTCU) regulate the access, use and purchase of products and services through the Dreambooks Editor software (hereinafter referred to as software).
The software for digital images treatment and creation of photographic products is owned by Laboratórios Fotográficos do Marco LDA, Zona Industrial de Tuías Rua 2, nº 90, 4630-489 Marco de Canaveses, PORTUGAL, Vat Nr 501191070, from now on referred to as the company.
Any person, then nominated by user, wishing to use the services of the Dreambooks Editor must accept these GTCU and all other policies and principles governing it. The acceptance of the GTCU is absolutely essential to use of the software and its services.
The user must read, make sure he has understood and accept all the conditions laid down in the GTCU, as well as in other documents incorporated by reference thereto, before the registration as a user of the Dreambooks Editor.
The company reserves the right to perform, at any time and without notice, any modification or updating of its content and services; of these GTCU and any element which integrates the design or configuration of the software. The modification of these does not affect the goods or promotions that were purchased before the changes.

Terms of Use

These Terms of Use regulate, together with the Privacy Policy, the access, use and purchase of products and services via the Website www.dreambooks.co.uk (hereinafter "Website"). Anyone nominated "User", wishing to use the services of Dreambooks must accept these Terms and Conditions, and all other policies and principles that rule it. Acceptance of terms of use is essential to use the website and its services.

1. General Conditions

1.1. Dreambooks Website offers a photo developing service, digital printing and photo products.

1.2. Any deliveries and servicesare ruled by the following sale terms standing at the time of order.

1.3. These terms and conditions apply only to users, i.e. individuals who choose our services, they cannot be extended to their commercial or professional activity.

1.4. The information on the website is subject to change (texts, images or other). All pictures of the products presented are merely illustrative and may differ to the final products for the customer.

2. User Account

2.1. The user has the possibility to register a free account, which enables him to manage all his projects and order data in an easier way anywhere in the UK. In general, access to services and content of the Website will not require any kind of register. However, this will be required for the use of some services and for the purchase of products. If the user wants his projects to be saved, he must register previously.

2.2. To access the user account the user needs an email address and a valid password chosen by him, which should be defined at the time of the account creation.

2.3. To use the user account, it is very important that the email address given to Dreambooks is valid. The main means of communication that Dreambooks will use is electronic mail. The user should give clear information and inform Dreambooks about any change of delivery address.

2.4. The user account is available 7 days a week, 24 hours a day. However, it may happen that, for maintenance purposes, interventions in the site or in the network or as a result of any incidents or disturbances, which Dreambooks is not accountable for, access to the site or user account is interrupted. Dreambooks cannot be held responsible for any loss or damage following that kind of interruption.

2.5. For added security, the user should keep the chosen password secret. Dreambooks cannot be held liable or responsable for any damages resulting from the unaothorized use of the password by third parties. The user must inform Dreambooks of any unauthorized use of his account and must change his password as soon as there is any reason to suspect it is no longer confidential.

2.6. The service is provided for an indefinite period. Dreambooks or the user can cancel this service by giving notice of 15 days. This notice can be given by Dreambooks through a message sent to the e-mail address associated with the user account. The user can give this notice through the section "Contacts".

2.7. When the user account is terminated, Dreambooks deletes the account, as well as all the photos and projects that are stored in it.

2.8. Dreambooks can, without prior recourse to any legal measure or the payment of any compensation, terminate the user service account and / or block access to the account or delete digital photographs placed in the user account if the current conditions are violated.

3. Use of Software

3.1. The software for processing digital images and creating photo products are property of Dreambooks.

3.2. This software can only be used individually under a private use. Any permanent or temporary, full or partial downloading, copying, reproduction, are prohibited. In what concerns Dreambooks platforms, translation, adaptation, modification or other transformation, as well as any kind of distribution are prohibited. The same applies to making its contents available to the public for free or by means of payment.

4. Users duties

4.1 The customer cannot use third party rights and Dreambooks reserves the right to not provide the service when we verify that the client is using another brand or other distinctive sign.

4.2. The user is responsible for all images transferred through the site or reproduced in www.dreambooks.co.uk. This implies that the user undertakes not to transfer or otherwise publish through the site, images or photographs, in violation of copyright or any other intellectual property of the law on the protection of personal data or any other legislation. Furthermore, it is prohibited to transfer, disseminate, order prints or any other products or to communicate via email any illegal content, especially images or photographs of minors engaged in sexual acts, or undermine the privacy or rights of others.

4.3. The user is responsible for any loss or damage resulting from violation of the previous clause and will reimburse Dreambooks of all expenses incurred by it as a result of such violation.

4.4. Dreambooks reserves the right to take, without notice, any adequate measure in case of solid evidence of such violation, without the user having the possibility of claiming any compensation from Dreambooks.

5. License photos transferred

5.1. Dreambooks has no right on the photos stored on their servers but a license with the sole purpose of fulfilling the service which the images are transferred for.

6. Copyright

6.1. Dreambooks reserves all copyright and other rights related to the service, as well as to contents, information, pictures, videos and published databases (hereinafter referred to as "protected property"). It is therefore expressly prohibited to change, reproduce, publish, transmit to third parties and / or in any other way make use of protected property, without the prior written permission of Dreambooks.

7. Purchase Conditions

7.1. The procedures for buying the Dreambooks photographic products are the following:

  • Select the option "Buy." Starting from any project previously created by the user, he must click "Buy" to start any purchase process.
  • Give the User information. The customer must disclose in a specific format his name and surname, address and phone number.
  • Select a payment method. The user must select one of the following forms of payment available: credit card or PayPal.
  • Approve the purchase. By confirming your purchase, the user agrees to purchase the products indicated and the preconditions of the website.

7.2. Once completed the ordering process, the user cannot renounce it. No order will bind Dreambooks while it is not confirmed by e-mail or by any other appropriate means of communication.

8. Right of revocation

8.1. You may revoke your contractual statement only in situations covered by national law.

8.2. The user-customized products cannot be returned as they hold the status of clearly personalized goods. If the user detects any production flaw which may be imputable to Dreambooks, he has 15 days to submit photographs showing the flaw to support@dreambooks.co.uk so that they can later be analysed by the technical department. In case the technical department considers those flaws as such, a new item will be delivered to the customer. However this will be shipped to the customer only after Dreambooks receives the defective item. If the client does not want to return the defective item, there will be no exchange.

8.3. In the event of revocation, the benefits received by both parties must be returned and refunded in case of any uses made (e.g., Interest, benefits of use). If the coupon has already been redeemed totally or partially, before the expiration date, the user has to refund the money. The user can avoid this obligation only when he has decided not to exercise the right of withdrawal. The duty to reimburse payments must be fulfilled within 30 days after purchase. The deadline for exercising the right of revocation by the user starts by sending the declaration of revocation or the coupon. The reimbursement deadline for Dreambooks begins with the receipt of the declaration of revocation or coupon.

9. Conservation Order

9.1. After receiving the order confirmation, you can track your order on our "Order Status" service available for this purpose.

9.2. Photos that are transferred to the site in order to place an order are kept for 20 days to allow you to resume your project without having to re-download them.

9.3. The moment an order is effectively made and paid for, the photos can be stored for a maximum period of 45 days, so that Dreambooks can solve any problems of execution or delivery which may arise. This period is extended when Dreambooks makes a new printing of your photos.

9.4. The conservation of files serves only the purpose of executing your order. Dreambooks can in no case send the files back to the users (e.g. after a stolen computer). It is advisable that the clients keep a copy of their photos.

10. Price

10.1. The prices appliable to the Printing Service are displayed on the Site at the time of completion of the order and then summarized in the order form. Prices are listed in Pounds and unless otherwise stated, all fees are included.

10.2. The shipping costs, unless otherwise stated, are not included. Information about the costs are on each page of the site.

11. Delivery

11.1. Dreambooks makes deliveries anywhere in the UK.

11.2. Dreambooks cannot be held responsible for delays or delivery problems.

11.3. The time limits indicated on the website are indicative, even if representative of average maturities. They cannot, under any circumstances, be grounds for compensation or cancellation of the order or any reimbursement.

11.4. Loss of packing order. If the order is not delivered within 1 month from the date of acceptance, you have 15 days to inform the brand. In this case, either a new printing of the order will be made without extra expenses, or you will be refunded of the amount paid, knowing that the choice between the two options belongs only to Dreambooks.

11.5. The user can check on each product page the shipping options and their prices and delivery times.

11.6. It is the obligation of the user to ensure the proper reception of the order. This includes the provision of complete and accurate delivery address as well as an electronic mailbox bearing the recipient's name. In the case of return of your order to Dreambooks, following an error on the client behalf (e.g. incorrect / incomplete / unknown delivery address refused acceptance of the delivery, unclaimed object at the postal station within the prescribed period), you cannot claim any compensation or reprint. Since it´s return to Dreambooks implies shipping costs, a referral can be made, and the customer must pay for the shipping costs. If the client does not want to choose this route, all orders returned will be immediately destroyed to preserve the privacy of our customers. In case of return by postal error, Dreambooks undertakes to reproduce and resubmit your order without additional expense to the client.

11.7. If despite all measures taken by Dreambooks to protect against any deterioration of photographs or other goods during transport, they arrive in a degraded state, please contact the customer support service after reception of the order and send us an e-mail with a photo as proof of the damage. Dreambooks will make a new impression of the product and it will resubmit it to you for free.

12. Retention of title

12.1. Any order delivered remains the property of Dreambooks until reception of the full amount of the order.

13. Payment and billing

13.1. Dreambooks proposes on the website payment by credit cards and PayPal. Dreambooks reserves the right to exclude certain methods of payment at the time of transaction.

13.2. The payment is effected immediately after order confirmation.

13.3. Validation of an order on the website or any other service offered by Dreambooks implies acceptance by the customer using the format for electronic invoicing.

13.4. Dreambooks cannot guarantee in any way that services provided by the company responsible for managing payments work free from errors, interruptions, malfunctions, delays or other imperfections.

13.5. Dreambooks cannot by responsible for the availability or not of the Services provided by the company responsible for the management of payments or the inability to use the Service.

14. Responsibility

14.1. In no event can Dreambooks be held responsible for indirect damage arising from any use of the Site or Services such as possible damage or loss of data. Dreambooks isn't responsible for any damage caused to the software and hardware of the users or third parties during the use of services offered on the site.

14.2. The company is not responsible for typographical errors, or others, in printing of photographic products, based on information provided by the user during the order process Moreover, Dreambooks cannot be responsible for the poor quality of the photographs and images printed by the users request, since Dreambooks doesn't perform any work of photograph improvement.

14.3. The Dreambooks printing machines are calibrated periodically to ensure colour consistency in accordance with industry standards printing. For this reason, the colour of the images sent by the user may differ when printed. Dreambooks doesn't assume any responsibility for this reason.

14.4. In case of damage attributable to Dreambooks, the brand is limited to the direct compensation of the exact value supported by the service user.

14.5. Every time a copy of an album/project is requested to Dreambooks, there is the possibility that the copy has some notable differences regarding color or tonality. In this cases, the responsibility of the order is always attributed to the customer, and for so, Dreambooks will not accept any complaint or responsibility.

15. Satisfied or Reimbursed

15.1. If you are not satisfied with the order you received, and as a gesture of good faith, Dreambooks provides the guarantee "Satisfied or Reimbursed". In order to take advantage of this warranty, the customer must simply call our customer support service within 2 weeks of the reception of the order. Dreambooks will ask you for a photo as proof of destruction of the order in question. You should return the order by mail (only if asked).

15.2. As an alternative to a refund, you can, if you wish, request a reprint to Dreambooks (with all expenses to our charge). As mentioned above, the user will be asked to provide evidence of the destruction order received initially. This warranty is available to you regardless of the reason for your complaint.

15.3. The guarantee "Satisfied or Reimbursed" is not applicable in cases where:

  • Orders not delivered by mistake or negligence of the customer (e.g. incomplete delivery address, postal address unknown or unclaimed order at the postal station, etc.).
  • Orders receiving a 'special treatment' associated with bulky parcels.
  • All orders purchased with promotional codes will not be reimbursed. In the case of a faulty product, Dreambooks may choose to replace the product with a new production.
  • The user-customized products cannot be returned as they hold the status of clearly personalized goods.

16. Customer service

16.1. In case of questions or complaints, please contact our customer support service via e-mail, phone or live chat.

17. Information Privacy

17.1. Dreambooks undertakes to protect your data. In general, any data that the user provides to Dreambooks are used exclusively for the treatment of the order.

18. Modifications to the Terms of use

18.1. Dreambooks may change at any time these Terms of use, seeking its improvement and the improvement of it´s services. Within 24 (twenty four) hours counting from the publication of the amendments, the user must communicate by e-mail if he doesn't agree with the new Terms of use. If there is no manifestation in time, Dreambooks will understand that the user accepted the new rules and the contract will continue.

18.2. The changes do not remain in force in relation to offers, purchases and commitments already started at the time that the same changes are published. For these, the Terms of Use will be effective with the previous wording.

19. Partial invalidity of clauses

19.1. If any provision, present or future, of the contract is or becomes wholly or partly ineffective / invalid or unenforceable, the validity of the remaining provisions of these Terms of use will not be affected as long as the execution of the contract, considering the following rules does not represent an obligation for a part that may not be required. The same applies if, after conclusion of the contract, there is a gap that must be complementary. The parties shall replace the void provision / null / void or unenforceable that is required by a provision effective supplement that in its economic legal content, layout matches the void / null / not feasible and the overall purpose of the contract.

20. Applicable law and competent court

20.1. These conditions were based on Portuguese law. Any dispute concerning the application of these and the use of the Website is subject to the exclusive jurisdiction of the courts of the home user.
